I'm unsure as to what you mean by 'safe' however. If you mean virus free, well any of the well known ones will be free of virii.

If you're meaning they don't infringe on copyright, that's an entirely different matter all together. The emulator software itself in almost every case does NOT infringe on the copyright however, an emulator requires an image file of a game to play. These are referred to as ROMs, and the legals of these are a bit more difficult. Because we're talking N64 most of the commercial games released for it haven't been termed abandonware yet and thus downloading a ROM of such a game would infringe on copyright.
